Overview

The Beach Bar Summer Games organized and sponsored by the Baldyga Group is fun for all. Spectators and competitors all have a chance to win over one hundred thousand dollars in cash and prizes!

Each week, for 9 consecutive weeks, $1,000.00 in cash and thousands of dollars worth of prizes will be given. Teams of 4 including at least one man and one woman will compete for the chance to win. Registration will be held every Saturday from 11:00 am to 12:30 pm. Teams must register each week to participate in the weekly event. Competition will begin at 1:00 pm and a new event will take place every hour until 5:00 pm.

The Beach Bar Summer Games will kick off with the first day of events on Saturday July 8th, with the final weekend being Saturday September 2nd and the final event on Sunday September 3rd. The winner of the final event will receive $10,000.00 cash and thousands of dollars worth of prizes bringing the purse for this event to $100,000.00 dollars

Spectators are competitors as well! Every Saturday during the competition, a raffle ticket will be provided for each bud product purchased and 10 tickets will be provided for the purchase of a bucket of buds. During the event, prizes will be raffled off and at the end of each event, 1 lucky raffle winner will spin the "Challenge wheel" for a chance to compete with the weekly winner to “steal” $500 from the winning team. No purchase necessary: an alternate method of entry is also provided.

Weekly competitions will be arranged in 4 categories:

  • Physical challenge

  • Game of Chance

  • Eating Competition

  • Brain Game

Every team who wins any individual event will automatically be entered into the finals on September 3rd for a chance at the $10,000.00 cash prize. If a team wins multiple events, they knock out other teams for the finals, increasing the odds of winning by reducing the number of competitors in the finals.

The finals on September 3rd will be a fun filled day with live music, great food & drinks and exciting competition. Don't miss your chance to win!

All competitors must be 21 years of age or older to participate.

The official venue of the Games will be "The Beach Bar & Grill." However, the beach Bar & Grill is not a Sponsor and does not accept any responsibility or liability whatsoever for any and all activities held or relating to the Games.

The Baldyga Group reserves the right, at its sole discretion, to change, modify, add or remove portions of: (i) the Official Rules; (ii) the Release and Waiver; and (iii) the Prize Distribution List for the Beach Bar Summer Games, at any time, and without giving prior notification or any reasons thereof. It is your responsibility to check (i) the Official Rules; (ii) the Release and Waiver; and (iii) the Prize Distribution List for the Beach Bar Summer Games periodically for changes. Your continued participation in the Beach Bar Summer Game following the posting of changes will mean that you have read, accept and agree to the changes.

Official Rules

Hafa Adai and welcome to the inaugural Beach Bar Summer Games sponsored by the Baldyga Group, LLC ("BG"). The Beach Bar Summer Games (the "Games") are fun for all. Competitors and spectators (collectively, "contestants") will all have a chance to win a share of $100,000.00 in cash and prizes during the course of the Games! Each Saturday, over 9 weeks, teams of 4 will compete for the chance to win up to $1,000.00 in cash and thousands of dollars in prizes. Each week, one raffle prizewinner will have a chance to compete with the weekly team winner for a share of the $1,000 weekly winner cash prize. The winners of each weekly event will automatically qualify to compete in the final event to be held on Sunday, September 3, 2017, and the chance to win the grand prize of $10,000.00 in cash and thousands of dollars worth of prizes

  1. How to Enter.
    1. The Games will be held every Saturday, beginning July 8, 2017, and ending on September 2, 2017. The final event for the Games will be held on Sunday, September 3, 2017. All activities related to the Games will be held at the Beach Bar.
    2. Teams must include 4 contestants; must be co-ed and include at least 1 male and 1 female contestant; and all contestants must be 21 years of age or older to participate. All contestants must present a valid government issued I.D. to participate.
    3. Registration will be held at the Beach Bar every Saturday during the Games from 11:00 a.m. to 12:30 p.m. for each week's events. Teams must register to participate in the weekly event. Competition will begin at approximately 1:00 p.m., with events taking place roughly every hour until 5:00 p.m.
  2. Eligibility Restrictions.
    1. The Games are open to all Guam residents, tourists and military personnel, who are 21 years or age or older.
    2. Employees of Baldyga Group and its companies and subsidiaries (the Beach Bar, TaoTao Tasi, Lina'La', SandCastle, Globe, Ride the Ducks, Le Petit Café and Sunset Cruise) ("BG Companies"), and the members of their immediate families are ineligible to participate in the Games or win prizes. Immediate family shall include spouse, parents, children, siblings, grandparents, grandchildren and any other person residing within the same household.
    3. Employees of Ambros, Inc., their subsidiaries, and the members of their immediate families are ineligible to participate in the Games or win prizes. Immediate family shall include spouse, parents, children, siblings, grandparents, grandchildren and any other person residing within the same household.
    4. Contestants must possess valid government issued photo identification.
  3. Prize Package.
    1. The list of prizes is set forth in the attached Prize Package sheet.
    2. Prizes are limited solely to those items explicitly set forth in the Prize Package sheet and shall not include any and all other expenses, incidentals, entertainment, or taxes that may arise out of the winner's receipt of a prize.
    3. Prizes may be transferred with the exception of Prizes provided by the BG Companies. Tickets to the SandCastle, Tao Tao Tasi and/or the BIG Sunset dinner cruise ("Tickets") may only be transferred with the expressed authorization of Baldyga Group. Tickets for all BG Tours will be awarded to the winner(s) and their name(s) will be printed on the certificate. Winner(s) must be present and must show photo ID to utilize the tickets. If transferred a new certificate will be issued by the Baldyga Group in the name of the transferee. All transferees shall accept transfer of the prize subject to these Official Rules. The prize(s) provided by the BG Companies, including but not limited to Tickets, that may be awarded to the eligible winner(s) are not redeemable for cash or exchangeable for any other prize and may not be resold.
    4. The prizes contained in the Prize Package or any part thereof that may be awarded to the eligible winner(s) may not be substituted for or redeemed for cash. The prize(s) provided by the BG Companies, including but not limited to Tickets, that may be awarded to the eligible winner(s) are not redeemable for cash or exchangeable for any other prize and may not be resold.
    5. Prizes will be awarded as is, with no written or express warranty.
    6. BG reserves the right, at its sole discretion, to substitute the prizes as listed on the Prize List at any time and for any reason or for no reason whatsoever.
  4. Selection of Winner.
    1. Each Saturday during the Games teams will compete in up to four (4) events to be selected the day of the competition in the following categories:
      1. Physical Challenge
      2. Game of Chance
      3. Eating Competition
      4. Brain Game
      The winning team in each of the four (4) categories will compete in a final competition to determine the weekly overall winner. The winning team in each category will automatically be eligible to compete in the finals to be held on September 3, 2017. If any weekly winning team fails to confirm by September 2, 2017 its intention to compete in the finals on September 3, 2017, a replacement team to fill that team's spot will be randomly selected from among the non-winning weekly teams or by raffle drawing.
    2. The odds of winning are based on the number of participants. If a team wins multiple events on during a Saturday competition, the team increases their odds of winning by reducing the number of teams in the finals.
    3. Rules for each event of the four (4) events will be provided prior to the start of each event on Saturday.
    4. Spectators may also be competitors. During every Saturday competition, one (1) raffle ticket will be provided for each Bud product purchased and ten (10) raffle tickets will be provided for each Bud bucket purchased, enabling participation by the purchaser in the Games ("Spectators Competition"). During the Saturday competition, prizes will be raffled off and at the end
    5. Baldyga Group reserves the right to set and to modify the event rules and prizes distributed at an event, at any time in its sole discretion and for any reason or for no reason at all. Baldyga Group will appoint a Games Committee with a Games Commissioner to oversee and conduct the Games. The decisions of the Games Committee and the Games Commissioner during each Saturday event and the final event are final.
  5. Conditions.
    1. Photo identification of the winners will be required in order to collect the prize. Payment of all federal, state and local taxes are the sole responsibility of the winners.
    2. General release. By entering the games, contestants release Baldyga Group and other sponsors, any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the games or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
    3. By participating in the Games and or the spectator raffle, the participants and spectators agree to have their names, voices, likenesses or replica used in any advertising or broadcasting material relating to the Games without additional financial or other compensation. Except where prohibited, entry in the Games constitutes each contestant's consent to Sponsors to use, publish, reproduce and for all purposes, including publicity, promotion and advertising, in any media (including without limitation, the Internet, television, radio, or offline promotions), each contestant’s name, village, photograph, likeness, biographical material, voice, image, each in perpetuity without further compensation, credit or right of review or approval.
    4. Baldyga Group reserves the right in their sole discretion to modify the Official Rules, prizes, dates and/or other details at its sole discretion and any time for any reason or for no reason whatsoever including in response to any disputes. Material modifications may, at Baldyga Group's discretion, be announced on the stations of Hit Radio 100 and Docomo Pacific, when practical. By participating in the Games, contestants agree to be bound by these Official Rules, any modifications thereof, and by all other rules imposed by Baldyga Group. If due to circumstances beyond the control of Baldyga Group, any event associated with the Games or the prize is delayed, rescheduled, postponed or cancelled, Baldyga Group reserves the right, but not the obligation, to cancel or modify the Games and shall not be required to award a substitute prize.
    5. Baldyga Group, in its sole discretion, reserves the right to disqualify any person it suspects may be tampering with the entry process or who is otherwise may be in violation of the Official BBSG Rules.
    6. No purchase is necessary for teams to register to participate in the Games. For the Spectators Competition, participants may pick up an entry form at the Baldyga Group office in Tumon Guam or by sending a self-addressed stamped envelope to: Baldyga Group 1199 Pale San Vitores Road Tumon, Guam 96913. The Games is void where prohibited.
    7. Failure to comply with the Official Rules or the event rules may result in a participant’s disqualification, at the sole discretion of the Baldyga Group or the Games Commissioner and the Games Committee.
    8. Baldyga Group reserves the right to substitute a prize of greater or equal value at its sole discretion.

    10. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of contestants and Sponsors in connection with the Games, shall be governed by and construed in accordance with the laws of Guam.
    11. By participating, contestants agree that they will not hold Baldyga Group or its affiliates or employees, the Games Commissioner or Games Committee, or Sponsors responsible for any action or errors including errors of omission or for determining a winner incorrectly or for any reason whatsoever.
  6. Venue.
    The official venue of the Games will be "The Beach Bar & Grill." The producer of the Beach Bar Summer Games is Baldyga Group, LLC, a Guam limited liability company. The Beach Bar & Grill is not Sponsor of the Games and does not accept any responsibility or liability whatsoever for any and all activities held or relating to the Games.

Release and Waiver

In consideration of being permitted to participate in and receive the prizes awarded in connection with the Beach Bar Summer Games (the "Games") organized and produced by The Baldyga Group, a Guam limited liability company referred to herein as ("BG") or "sponsor"), the undersigned ("participant") agrees as follows:

The Games. Participant agrees to participate in the Games and cooperate with sponsor’s representatives, employees, producers, coordinators, film crew and officials on the following dates and times and at the location selected by Sponsor:

  • Saturday, July 8, 2017 beginning at 11:00 a.m. and concluding at 5:00 p.m.

  • Saturday, July 15, 2017 beginning at 11:00 a.m. and concluding at 5:00 p.m.

  • Saturday, July 22, 2017 beginning at 11:00 a.m. and concluding at 5:00 p.m.

  • Saturday, July 29, 2017 beginning at 11:00 a.m. and concluding at 5:00 p.m.

  • Saturday, August 5, 2017 beginning at 11:00 a.m. and concluding at 5:00 p.m.

  • Saturday, August 12, 2017 beginning at 11:00 a.m. and concluding at 5:00 p.m.

  • Saturday, August 19, 2017 beginning at 11:00 a.m. and concluding at 5:00 p.m.

  • Saturday, August 26, 2017 beginning at 11:00 a.m. and concluding at 5:00 p.m.

  • Saturday, September 2, 2017 beginning at 11:00 a.m. and concluding at 5:00 p.m.

Sponsor reserves the right at its sole discretion, to change the dates and times of the Games, including delaying, canceling, or suspending the Games due to inclement weather or other potential safety risks.

Eligibility. Participant must be 21 years of age or older. Participant must possess valid government issued photo identification. No purchase is necessary to compete as a participant. However, I understand and accept that Spectators are competitors as well and that during the competition, that for each Bud product purchased, the purchaser will receive a raffle ticket enabling his/her participation in the Games as a "Spectators Competitor". The Games is void where prohibited.

Participant's Obligations. Participant is responsible for all taxes and expenses associated with the Games prize receipt and/or use.

Participant, on behalf of himself and his heirs, successors, assigns and personal representatives, shall indemnify and defend sponsor and sponsor's respective licensees, assignees, and their respective officers, employees, advertisers, insurers and representatives and hold each of them harmless against any and all claims, demands, liabilities, actions, costs, suits, attorney fees, proceedings or expenses, incurred by any of them, arising out of PARTICIPANT’s acts, conduct, transactions and/or omissions during or related to the Games. Such indemnification shall include all claims arising out of, or related to, directly or indirectly, any acts, conduct, transactions and/or omissions of participant occurring during the Games and/or participant's use, non-use or misuse of the prizes received through the Games.

Participant on behalf of himself and his heirs, successors, legatees, assigns and personal representatives, and all those claiming by or through him, independently and collectively, hereby releases and holds harmless sponsor and its affiliates, agents, servants, employees, assigns and successors from any and all claims, losses, damages or expenses for personal or bodily injury (including death), and property loss or damage incurred by participant or arising out of or in connection with his participation in the Games.

Participant understands and agrees that the foregoing release, waiver and indemnity is intended to be as broad and inclusive as permitted by the laws of the Territory of Guam and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and effect.

Participant acknowledges that he/she has carefully read the above paragraphs and fully understands and appreciates their meaning and signs this release and waiver of his/her own free will. Participant further acknowledges that he/she is over the age of 21 and is legally competent to sign this release and waiver.

Prizes; No Royalties. Participant acknowledges that if he/she is a Games winner, he/she will be awarded the following prizes, which shall be delivered to a location designated by BG: [Please see posted prize listing]. Notwithstanding the foregoing, Participant acknowledges and agrees that sponsor shall not be liable in any way to pay participant, nor shall participant be entitled to any royalties, residuals, fees, or any other compensation in connection with the Games.

Media. By participating in the Games, paticipant hereby grants to sponsor and sponsor hereby accepts, the exclusive right to videotape, film, photograph, or otherwise record, or to authorize others to do so, by any media now known or hereinafter discovered, participant's appearance, participation, commentary, and any other work product for the Games. (These recordings by tape, disc, film, or otherwise are collectively referred to herein as the "Programs.") Baldyga Group shall be the sole owner of the Programs.

Participant consents to the use and reuse by Baldyga Group and any of its licensees, assigns, parents, subsidiaries, divisions, business units, or affiliated entities and its employees, agents, officers and directors of his/her voice, actions, likeness, name, appearance and biographical material (collectively "Likeness") in any and all media now known or hereafter devised, in perpetuity, in any and all versions now known or hereafter devised (including digitized versions) in, or in connection with the Games. Participant agrees that his/her Likeness may be used, and may be altered or modified, regardless of whether or not participantis recognizable.

Participant further agrees that Baldyga Group owns all right, title, and interest in and to any application materials (e.g., video, photos, etc.) that Participant has provided in connection with his/her application for or participation in the Games and any photos or videos of any kind made by Baldyga Group, if any, in connection with the Games or Participant’s application therefore ("Material"). Except where prohibited, entry in the Games constitutes Participant’s consent to sponsor to use, publish, reproduce and for all purposes, including publicity, promotion and advertising, in any media (including without limitation, the Internet, television, radio, or offline promotions), participant’s name, village, photograph, likeness, biographical material, voice, image, each in perpetuity without further compensation, credit or right of review or approval.

Baldyga Group shall have the right to produce, reproduce, reissue, manipulate, reconfigure, license, manufacture, record, perform, exhibit, broadcast, televise by any form of television (including without limitation, free, cable, pay cable, closed circuit and pay-per-view television), transmit, publish, copy, compile, print, reprint, vend, sell, distribute and use via any other medium now known or hereinafter discovered, and to authorize other to do so, the Programs, Likeness and Material in perpetuity, in any manner or media and by any art, method or device, now known or hereinafter discovered (including without limitation, by means of videodisc, videocassette, optical, electrical and/or digital compilations). Participant agrees that sponsor may use his/her Likeness and Material in connection with any promotion, publicity, marketing or advertisement in any manner whatsoever.

Disqualification. Sponsor reserves the right to disqualify any entrant if sponsor determines in its sole discretion that awarding a prize to participant might reflect negatively on sponsor. Sponsor reserves the right to cancel, suspend and/or modify the Games, or any part of it, if it suspects any fraud, technical failures or any other factor beyond sponsor’s reasonable control impairs the integrity or proper functioning of the Games, as determined by sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it suspects or finds to be tampering with the Games or to be acting in a disruptive manner. Participant acknowledges and agrees that disqualification may result in, among other things, the immediate forfeiture of any prize otherwise awarded or awardable.

Exclusivity. It is the understanding of the parties that all rights, licenses, privileges and all other items herein given or granted or assigned by participant to sponsor is exclusive to sponsor even to the exclusion of participant.

Miscellaneous. Nothing contained in this Release and Waiver shall be construed to constitute participant as an employee, partner or joint venturer of SPONSOR, nor shall participant have any authority to bind sponsor in any respect. Any term or provision of this Release and Waiver which is invalid or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective to the extent of such invalidity or unenforceability without rendering invalid or unenforceable the remaining terms and provisions of this Release and Waiver, or affecting the validity or enforceability of any of the terms or provisions of this Release and Waiver in any other jurisdiction. This Release and Waiver shall be governed by and interpreted in accordance with the laws of the Territory of Guam. Participant hereby consents to venue and jurisdiction of the local courts of the Territory of Guam for any action arising from this Release and Waiver. Participant acknowledges that sponsor disclaim responsibility for delays or cancellations of the Games caused by forces of nature or other circumstances beyond its control.

Participant acknowledges, understands and agrees that Baldyga Group, LLC, a Guam limited liability company is the producer of the Beach Bar Summer Games and that the beach Bar & Grill is simply just the venue for the Games. The Beach Bar & Grill is not a Sponsor of the Games and does not accepts any responsibility or liability whatsoever for any and all activities relating to the Games."

Participant acknowledges, understands and agrees that no food or beverages, including alcoholic beverages will be allowed on the premises except as sold by the beach Bar & Grill.
